Terms of sale
Terms of sale
Version 1, last updated date. You can print this page or save it as a PDF from your browser. The terms that apply to your order are the ones on this page when you paid, and your order confirmation email links to them.
1. Who you're buying from
You're buying from Park Studios CC, a close corporation registered in South Africa, registration number 2010/104393/23, trading as Jacques Grobler Photography. In these terms "I" and "me" means Park Studios CC. "You" means the person placing the order.

Park Studios CC is not registered for VAT, so no VAT is charged and none is shown on your invoice. All my contact and company details are on the Contact information page.
2. What you're buying
Each print is a photograph by Jacques Grobler, printed to order by Orms Print Room in Cape Town on the paper, in the size and with the frame (if any) you choose. The product page describes each one: the image, size, paper, finish, frame and, for limited editions, the edition size.
Screens show colour and brightness differently from paper, and every screen is different. The pictures on the site show what the print looks like, but a small difference between your screen and the paper is normal. A print that is clearly wrong is a fault, and Returns and faulty prints explains what happens then.
Buying a print gives you the print. It doesn't give you the copyright or any right to copy the photograph. See the Terms of use.
3. How an order works
- You choose a print, its size, paper and frame, and add it to your basket.
- Before you pay, the checkout shows your whole order and the total. You can change or remove anything, or leave without buying.
- You pay on Payfast's secure page.
- Once the payment goes through, the sale is made, and I email you an order confirmation. If you don't get it within an hour, check your spam folder and then email me.
- Your print is then made for you. Nothing is printed before you pay.
If I can't fill your order, for example because a limited edition has sold out at the same moment, I'll tell you straight away and refund you in full within 7 days.
4. Prices
Prices are in South African rand and are the full price. Delivery inside South Africa is free and is included in the price. For delivery outside South Africa, the delivery cost is shown at checkout before you pay. Import duty and tax charged by your country are not included and are paid by you on arrival: see Shipping and delivery.
The price you pay is the price shown in the checkout when you paid. If a price is plainly wrong because of a mistake on the site (for example R15 instead of R1 500), I'll contact you before printing. You can then pay the correct price or cancel for a full refund.
5. Payment
Payment is taken by Payfast. You can pay by credit or debit card, Instant EFT and the other methods Payfast shows at checkout: list once the account is live. Payfast handles your card or bank details on its own secure page. They never reach me and I never store them. This website is served over an encrypted connection.
6. Making and delivery
Your print goes to the printer after payment. Typical times:
- Unframed prints: dispatched within 3 working days of payment.
- Framed prints: dispatched within 7 to 10 working days of payment.
- Delivery in South Africa: usually 2 to 4 working days after dispatch, by The Courier Guy, with tracking.
Limited editions are signed by Jacques before dispatch, which can add X working days.
The full detail, including international delivery and holiday cut-off dates, is on Shipping and delivery. If your order hasn't been delivered within 30 days of payment, you may cancel it and I'll refund you in full.
The print is my responsibility until it's delivered to you. If it's lost or damaged on the way, I sort it out: see Returns and faulty prints.
7. Cancelling
Straight after ordering. If you've made a mistake or changed your mind, email me with your order number as soon as you can. If printing hasn't started, I'll cancel the order and refund you in full.
After printing has started. Each print is made to your specifications after you order it, so you can't cancel or return it because you've changed your mind. The 7 day cooling-off right in section 44 of the Electronic Communications and Transactions Act doesn't apply to goods made to the consumer's specifications (section 42(2)(f)).
Faulty, damaged or wrong prints are a different matter. You can have them reprinted or refunded, your choice, for six months after delivery. See Returns and faulty prints.
8. Limited editions
Edition mechanics are not decided (open question A8). When they are, this section says: the edition size, that it never grows once set, how each print is numbered and signed, whether a certificate comes with it, and what happens if the last number sells twice at the same moment.
9. Please read this part: limits on my responsibility
I'm responsible for getting you the print you ordered, in good condition, and for putting it right if it isn't. Beyond that:
- I'm not responsible for loss that couldn't reasonably have been foreseen when you ordered, such as the cost of a frame or wall fixings you bought separately, or a missed occasion because a delivery was late.
- If something goes wrong, the most I'll pay you is what you paid for the order, unless the law says otherwise.
Nothing in these terms limits your rights under the Consumer Protection Act or the Electronic Communications and Transactions Act, or my responsibility for my own gross negligence.
10. Problems and complaints
Email me first at [email protected] with your order number. I'll reply within 2 working days and try to put it right. If we can't agree, you can take a complaint to the National Consumer Commission or the Consumer Goods and Services Ombud.
I'm not a member of any industry or self-regulatory body, I don't subscribe to any code of conduct and I don't use any alternative dispute resolution scheme.
11. The law that applies
These terms are governed by South African law. If you live outside South Africa, you also keep any rights the consumer law of your own country gives you.
12. Changes
I may update these terms for future orders. An order is always governed by the version that was on this page when you paid.
